Sep 5, 2019 at 10:48 comment added Iñaki Viggers @Chrome When referring to good faith, one should distinguish between (1) a duty to act with honesty in accordance with the contract, and (2) pursuing each other's interests. Compared to other jurisdictions, English law is only more emphatic in that the parties are entitled to pursue their own interests (rather than each other's). But that emphasis does not extend to an entitlement to disavow clauses simply on grounds that a contract only says "terms" instead of "terms and conditions".
