Oct 26, 2023 at 10:06 comment added Dale M @JeopardyTempest yes. They usually don’t though. The laws are targeted at organised crime where there are assets but no legitimate way the could have been obtained.
Oct 26, 2023 at 9:54 comment added JeopardyTempest @vsz So how far can that go? If you steal $100, can e.g. the government take your wages for the next month saying you may've used the $100 as gas to get to work!?!?!
Oct 26, 2023 at 8:50 comment added Andrew Morton @AlanSTACK The USA has something called "civil asset forfeiture" whereby the police can take money from you if they happen to find it in your possession. For example, if you're going to buy a second-hand truck for $40,000 cash, the police can take that from you and you then have to prove that the money was innocent if you want it back.
Oct 26, 2023 at 8:20 comment added Dale M @vsz the government doesn’t have to, the thief has to prove the gambling money was obtained lawfully
Oct 26, 2023 at 5:32 comment added vsz To prove that the thief has stolen $10,000 is much easier than to prove that the exact same money was used for gambling. Even if the amount is similar, money is fungible. How to prove beyond reasonable doubt that it was the exact same money?

Oct 26, 2023 at 3:04 comment added Dale M @AlanSTACK pretty much all government reverse the onus of proof for proceeds of crime legislation.
Oct 26, 2023 at 1:31 comment added AlanSTACK "If you can't prove it wasn't the stolen money, the government gets it." Does this statement only apply to this specific question, or with dealing with the US government in general?
Oct 26, 2023 at 1:26 comment added Dale M @AlanSTACK you clearly aren't familiar with proceeds of crime legislation - if you can't prove it wasn't the stolen money, the government gets it. They don't have to prove it was.
Oct 26, 2023 at 1:09 comment added AlanSTACK How would anybody find out if that were the exact 10K stolen and not a different 10K they had lying around?
