Can the United States Government ban the distribution of certain pieces of software?

  • It is well established that not all speech is protected by the first amendment. It follows that not all software is protected by the first amendment. The more interesting question is "what does the government have to show to justify banning the distribution of a given piece of software (or other speech)?"
