My mother died 6 weeks ago. My sister lived with her, and took care of her for a long time. I give her credit for that.

Since mom has died, sister is holding onto the will. Our brother is the executor and has given our sister "time", and not filed the will to open probate in Kentucky. I told him if he didn't file the will, I would hire a lawyer and they would go after him not our sister.

He has told me twice she is going to leave mom's house. She hasn't. I asked my sister for a copy of the will. She screamed at me that she is not the executor and I was a bitch.

Is my sister and niece legally able to stay in the house without showing the will? I am seeing an attorney next week.

    Have you asked your brother for a copy of the will? It would be odd if the executor doesn't have one, and your attorney will want to see it. – Paul Johnson Feb 8 '19 at 14:16
