Under Australian federal law, it is illegal to import or posess a hand-held, battery powered laser pointer which is above 1mw in power - without a weapons permit.

I am planning on purchasing a legal <1mw laser pointer on eBay, however I am aware that sellers often intentionally mislabel these items to get them through customs.

If I purchase one advertised as <1mw and the seller actually sends something above the legal limit, am I subject to a fine if this is confiscated by customs? I do not possess a weapons permit.

Australia has some of the strictest customs laws in the world and I am concerned that if an item were to be confiscated, it would be assumed that I had attempted to import the item and I would not be given an opportunity to prove otherwise.
