Feb 19, 2019 at 8:29 comment added nikk wong I understand your perspective that the photo is about the graffiti. However, in my perspective, the photo is about my product and the model holding it, and the graffiti complements it. I think an argument could be made for both sides.

If it were a photograph of a larger scene where the graffiti just happened to be visible in part of it, there would be a good question, but here the entire composition is based on the graffiti. If you didn't care about having it there to make the photo stand out, the same subject could have been photographed in a studio or anywhere else with nothing specific to the location lost.
